Dear SDTA Members,

SB-138 will be coming up for hearing perhaps early next week in the House Agriculture & Natural Resources Committee. This is a very serious anti-trapping bill that was introduced by a legislator in the Yankton area. The bill has already passed the senate committee and full senate. Nobody was aware that the bill hit the senate committee hearing earlair this week. Therefore, since there was no opposition the bill easily passed through basically unnoticed. We have a chance to change this next week. Several letters were sent out this morning to SDTA members who do not have E-mail address. We are hopeful that all of you can make one or more calls to one of the 13 members on the House Agriculture & Natural Resources Committee and also pass this information on to other trappers that you know and friends of trappers. We will have representation at the house committee hearing next week to represent trappers. Make some calls this week end or if that is not possible make calls right away early next week. You can also send an E-mail message by going to the SD Legislative Web page. There you can click on to Your legislators, then click one of the names of the 70 representatives. From there you can click on E-mail to write a message. Any message does not need to be long. Just state who you are and present basic information about your concerns for this bill and the future of trapping in SD.

The following is what SB-138 says: Part of the bill was amended in the senate, but, the bill is still completly unacceptable.

SECTION 1 No person may install on any public right-of-way any conibear, body, or leghold animal trap within one thousand twenty feet of any occupied dwelling unless the person informs the owner or lessee of the dwelling of the location and characteristics of the trap and posts a sign no more than 20 feet from the trap to inform passersbys of the location and characteristics of the trap. The Game, Fish & Parks Commission shall promulgate rules pursuant to chapter 1-26 to specify requirements and methods to meet the notification and posting requirements of this section and to specify the types and characteristics of traps that are governed by this section.

SB-138 is a very serious anti-trapping bill that will seriously discourage more young people from wanting to trap in the future. It will have a detrimental impact on numerous trappers in SD. and the future of trapping in South Dakota. If this bill would pass into law if would give the animal rights activists a major victory without even a fight, or the expendidure of a single dime of their multi-millions of dollars. You can help stop this non sense by making call, e-mails and also by informing other traps about the issue and encourage those people to also send messages.

It is unfortunate that this bill was introduced in the legislature this year based on an incident near Yankton, SD where a dog was trapped and killed in a 220 body-grip trap. I think we all regret that this incident took place and certainly we all can sympathize with the dog owner since many of us have our own prize pets that we do not want to see harmed in any way. However, unfortunate accidents like this do happen. Hopefully, we can all do more to minimize these types of incidents in the future through more education to the public about trapping. Also, each trapper needs to use the best common sense and judgment when placing traps in areas where there is alot of public use. We all know that this in not always the case everywhere. But, surely we do not feel that the entire state trapping community should have to bite the bullet because of one of these types of isolated incidents.

We all need to do our best to avoid incidental catches to keep public opinion on our side. All SD trappers can help by respecting the current 660 foot safety zone from occupied dwellings.
